1. Introduction

Welcome to Kesi Split ("App," "Service"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you") and Andres Mariscal Lozano ("Company," "we," "us," or "our").

By accessing or using Kesi Split, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Eligibility

Our Services are not directed to children under the age of 13. By using the App, you represent and warrant that:

1. You are at least 13 years of age.
2. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and that they have agreed to these Terms on your behalf.
3. You have the full right, power, and authority to enter into this agreement.

3. Description of Services

Kesi Split is a utility designed to assist users in calculating and splitting shared expenses through manual input and Optical Character Recognition (OCR) receipt scanning.

No Financial Services

The App is strictly a calculation and record-keeping tool. We do not:

• Process, transmit, or hold funds.
• Act as a bank, money transmitter, or payment processor.
• Verify the debts or obligations recorded in the App. All settlements of debts calculated by the App must be handled outside of the Service (e.g., via cash, bank transfer, or third-party payment apps).

4. Accounts and Access

• Guest Access: You may use the App as a "Guest." Guest features are limited and do not include access to the camera scanner or cloud synchronization.
• Registered Accounts: To access full features (including receipt scanning), you must create an account. You are responsible for maintaining the confidentiality of your login credentials.
• Termination: We reserve the right to suspend or terminate your access to the App immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

5. User Content and Permissions

• Your Data: You retain all ownership rights to the receipts, images, and data you upload ("User Content").
• License to Us: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process that content solely for the purpose of providing and improving the App (e.g., processing the image to extract prices).
• Camera Usage: The App requires access to your device's camera to function. This access is used strictly for scanning receipts.

6. Fees and Payments

• Subscription Model: Kesi Split offers both free basic access tiers and paid premium subscription plans (e.g., for unlimited receipt scanning). Subscription pricing and details are displayed within the App prior to purchase.
• Billing & Payments: Premium subscriptions are billed and processed securely through the Apple App Store or Google Play Store. Payments are subject to the terms and billing policies of the respective app stores.
• Changes to Fees: We reserve the right to modify pricing, subscription tiers, or introduce new charges. Any pricing adjustments will be communicated in advance, and existing subscriptions will only renew at adjusted prices with notice and according to App Store/Google Play policies.

7. Disclaimers and Limitations of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis.

• Accuracy Disclaimer: You acknowledge that the App's OCR (receipt scanning) technology and split calculations may contain errors, misinterpretations, or inaccuracies. You are solely responsible for verifying the accuracy of all calculations and data extracted by the App before settling any debts. We are not liable for any financial losses or disputes arising from mathematical errors or OCR misreads.
• Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

8. Governing Law and Dispute Resolution

Governing Law

The laws of the State of Texas, United States, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. 10. App Store Terms

If you downloaded this App from the Apple App Store or Google Play Store:

• You acknowledge that this agreement is between you and us only, not with Apple or Google.
• Apple and Google are not responsible for the maintenance or support of this App.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
